The Planning Commission of the City of Newport will hold a regular meeting at 7:30 p.m., MONDAY, January 9, 2006, at the Newport City Hall, Council Chambers, 169 SW Coast Hwy., Newport, OR 97365.  A copy of the meeting agenda follows.

 

The meeting location is accessible to persons with disabilities.  A request for an interpreter for the hearing impaired, or for other accommodations or persons with disabilities, should be made at least 48 hours in advance of the meeting to Peggy Hawker, City Recorder, 541-574-0613.

A.        Approval of Minutes.

 

            1.         Approval of the work session meeting minutes of December 12, 2005.

            2.         Approval of the regular session meeting minutes of December 12, 2005.

 

B.        Citizens/Public Comment.

 

1.         A Public Comment Roster is available immediately inside the Council Chambers.  Anyone who would like to address the Planning Commission on any matter not on the agenda will be given the opportunity after signing the Roster.  Each speaker should limit comments to three minutes.  The normal disposition of these items will be at the next scheduled Planning Commission meeting.

 

C.        Consent Calendar.

 

1.         Final Order for File No. 3-SUB-05.  Approval of a tentative subdivision plat submitted on behalf of Home Depot USA, Inc., involving Lincoln County Assessor’s Map 11-11-17-CA (Tax Lots 200, 2703, 3200, 3501, and 3600), Assessor’s Map 11-11-17-DB (Tax Lot 1800), and Assessor’s Map 11-11-17-DC (Tax Lot 1400).  A public hearing was held on this matter on November 14 and November 28, 2005, with final deliberation on December 12, 2005.

            1.         Quasi-Judicial Land Use Actions

 

A.        File No. 1-AX-05 / 5-Z-05.  A request submitted by Bridgeview Enterprises, LLC, D & M Hurley, LLC, PAABS, LLC, RMK Properties (as tenants in common) (Kevin Cameron and Mel Hurley, Authorized Agents) for consideration of a request to (1) include a certain territory (consisting of the east 40 acres only of Assessor's Tax Map 11-11-4 Tax Lot 200 – the south half of the northwest quarter, Section 4, Township 11 South, Range 11 West, Willamette Meridian, Lincoln County (east 40 acres only)) into the Newport city limits through annexation; (2) amend the City of Newport Zoning Map to establish a zoning designation for the subject property of R-1/"Low Density Single-Family Residential" or R-2/"Medium Density Single-Family Residential" consistent with the existing Newport Comprehensive Plan designation of Low Density Residential; and (3) withdrawal of said territory from the Newport Rural Fire Protection District and the Lincoln County Library District.

 

B.         File No. 16-CUP-05.  A request submitted by Oakdell, LLC (dba The Landing) (Curtis Hofstetler, authorized agent) for the approval of a conditional use permit in a W-2/”Water-Related” Zone to allow for one of the units of The Landing to be converted from a water-related use (former charter office/bait shop/store space) to a condominium motel unit thereby modifying the original conditional use permit (File No. 10-CUP-98) which approved The Landing as a 54-unit condominium/motel by adding the additional condominium motel unit.  The subject property is 890 SE Bay Blvd. Unit B-2; Assessor’s Tax Map 11-11-09-CB (Supplemental), Tax Lot 70320.

 

C.         File No. 17-CUP-05/4-NB-05/20-VAR-05.  Requests submitted by Tim and Lisa Cornelius for approval of the following three land use requests for a proposed development (entitled “Moon Shadow”) consisting of a total of 14 vacation  rental units and 2 commercial retail units on property in a C-2/"Tourist Commercial" zoning district within the Historic Nye Beach Design Review District (HNBO).   The subject property is at 102, 108 & 114 NW Coast Street; Assessor’s Tax Map 11-11-8-BB, Tax Lots 6500 & 6600. 

 

File No. 17-CUP-05 is a request for a conditional use permit per Section 2-4-16.030 (A) (2) of the Newport Zoning Ordinance (NZO) for a conditional use permit for a building (under the building code buildings connected by common stairways are considered to be one building) within the Historic Nye Beach Design Review District with an exterior dimension of 100 feet or more. 

 

File No. 4-NB-05 is a request for design review for the proposed development under the design guidelines for new commercial buildings in the Historic Nye Beach Design Review District.

 

File No. 20-VAR-05 is a request for a variance to the 5 foot landscaped buffer requirement of NZO Section 2-4-4.010 between a non-residentially zoned property and a residentially zoned property as modified for properties within the Historic Nye Beach Design Review District pursuant to NZO Section 2-4-16.030 (A) (4).  The variance requested would allow portions of the proposed rear parking area on the east side of the property to intrude into the 5 foot landscaped buffer otherwise required between the C-2 zoned subject property and the R-4/"High Density Multi-Family Residential" property to the east of the subject property.
