The Planning Commission of the City of Newport will hold a regular meeting at 7:00 p.m., Monday, July 23, 2007, at the Newport City Hall, Council Chambers, 169 SW Coast Hwy., Newport, OR 97365. A copy of the meeting agenda follows.

1. Approval of the regular session meeting minutes of July 9, 2007.
B. Citizens/Public Comment.
1. A Public Comment Roster is available immediately inside the Council Chambers. Anyone who would like to address the Planning Commission on any matter not on the agenda will be given the opportunity after signing the Roster. Each speaker should limit comments to three minutes. The normal disposition of these items will be at the next scheduled Planning Commission meeting.

Quasi-Judicial Land Use Action:
1. Continued Hearing on File No. 7-CUP-07. A request submitted by Teton Creek, LLC (Pavitt Land Use Consulting, LLC, authorized representative) for approval of a Type I Conditional Use Permit per Section 2-2-1.025 (D) (13)/"Residential Uses" of the Newport Zoning Ordinance (NZO) (No. 1308, as amended) to allow for the use of 24 residential condominium units currently under construction located in three buildings to be used as vacation rentals in an R-4(HNBO)/"High Density Multi-Family Residential" (Historic Nye Beach Design Review District) zoning district for property identified as Tax Lots 800-1200 of Lincoln County Assessor's Tax Map 11-11-5-CB. This matter was continued from the June 11, 2007, Planning Commission meeting.
2. File No. 8-VAR-07. A request submitted by M & N Construction (William & Sheryl Lightner, property owners) (Amy Olsen, authorized representative) for approval of a Type I variance pursuant to Section 14A.02 (A) of the Newport Sign Ordinance (No. 1330, as amended) to allow painted wall signs of 131 sq. ft. on the south end and one of 25.8 sq. ft. on the SW gable end of a newly-construction 4,000 sq. ft. building, for a total of 156.8 square feet of signage. The signage square footage request of 156.8 square feet exceeds the 60 square-foot maximum aggregate area of signing allowed for a business in a Commercial (C-1) zone of the Agate Beach area by 96.8 square feet. [Section 15.07 (1) (c) limits commercial and industrial properties without a Highway 101 frontage in the Agate Beach area to a total of 60 square feet per frontage.] The subject property is located at 5220 NE Shell World Pl. (the new Shear Sensations Day Spa) (Assessor's Map 10-11-29-BD; Tax Lot 8900).
