Land Use Action:

novo public hearing to
consider the appeal (submitted by appellants, Robert & Cheryl Connell) of
the Community Development Director’s January 5, 2007, decision in Final Orders approving
the following two land use requests (submitted by Katharine Ramsey and William
Brusselback & Tara Picken) in File No. 8-PLA-06/10-VAR-06:
File No. 8-PLA-06 consisting of a property line adjustment as provided for by Section 2
of the City of Newport’s Property Line Adjustment Ordinance (No. 1674, as
amended) in order to move the common boundary line between Tax Lots 1200 &
1300 of the Lincoln County Tax Assessor’s Map 11-11-08-BD (429 & 437 SW 5th
St.) (Lots 10 & 11, Block 63, CASE & BAYLEY’S SECOND ADDITION) 4.5 feet
to the east to reflect what the applicants believe is the historic location of
the property line evidenced by the existing rock wall. The subject property is located in an R-3/”Medium
Density Multi-Family Residential” zoning district; and
File No. 10-VAR-06 consisting of a Type II Variance to Section 2-3-3.005 (Minimum Lot
Size) of the Newport Zoning Ordinance
(NZO) (No. 1308, as amended) to allow a lot to be 4,720 square feet with a minimum
width of 47.33 as the result of the requested property line adjustment (File
No. 8-PLA-06), which is 280 square feet (5.6%) under the 5,000 square foot
minimum lot size requirement and 2.67 feet (5.3%) below the minimum width of 50
feet in the R-3/”Medium Density Multi-Family Residential” zoning district for
property located at 429 SW 5th Street (currently identified as
Lincoln County Assessor’s Map 11-11-08-BD Tax Lot 1200 and described as Lot 10,
Block 63, CASE & BAYLEY’S SECOND ADDITION, in City of Newport, County of
Lincoln, Oregon).
